Retired cop challenges disciplinary action for abuse allegations

A former senior police officer facing over 50 allegations of inappropriate and oppressive behaviour towards his subordinates is attempting to halt disciplinary proceedings against him.

The case began in 2021 when 11 officers, both male and female, filed written complaints about the officer’s conduct.

An internal investigation was conducted by an assistant chief constable and concluded the same year. However, as of April 2024, the disciplinary process remains incomplete.

The accused officer retired on April 1, prompting his lawyer to submit a request to the Disciplinary Committee to discontinue the proceedings. The request cites legislation barring the prosecution of civilians for police disciplinary offences.

This request comes despite the ongoing hearing, which recently heard evidence from the investigating officer. The hearing was scheduled to continue but has been postponed due to the request for dismissal.

Philenews reports that the prosecuting authority is currently reviewing the legal implications, as relevant precedents are scarce.

The Disciplinary Committee intends to complete the process, given proceedings began while the officer was still in service. However, they will await the official position of the prosecution regarding the legal challenge.

The Committee comprises a representative of the Law Office, a senior Ministry of Justice official, and a senior police officer.

The case has experienced numerous delays due to changes in committee membership and the accused officer’s period of sick leave.
