82-year-old’s appeal hearing scheduled for tomorrow

Relevant News

Tomorrow at 10:30 in the morning, the first appearance in the appellate court has been scheduled concerning the appeal against the initial decision of the Limassol Permanent Criminal Court for the 82-year-old man who was sentenced to an immediate imprisonment of two and a half years for shooting the would-be thief who entered his property.

During tomorrow’s proceedings, relevant instructions are expected to be given, followed by speeches.

As reported in a previous article by philenews, the 82-year-old was discharged last Friday after 14 days of hospitalisation at the Pathological Department of Limassol General Hospital.

He was then taken to a cell in the Limassol Police Detention Centre, where he remains until today.

As our website can confirm, the 82-year-old will remain in detention until his appeal is adjudicated.

The request by the 82-year-old’s lawyers, Maria Neophytou and Antonis Antoniou, for a swift trial has been accepted, with the Court of Appeal scheduling the first appearance for tomorrow.

In the extensive appeal notification, the lawyers for the 82-year-old contested the decision of the lower court (Limassol Permanent Criminal Court), arguing that the imposed penalty was not appropriate under the circumstances.

Among other points, they highlight that the request for a suspended sentence should have been accepted, taking into account all mitigating factors.

Challenging the initial decision, they refer to the serious health issues faced by the 82-year-old, the specificity of the case, the particular events, his personal circumstances, and his age.

During tomorrow’s proceedings, the intentions of the Legal Service regarding its actions concerning the appeal are expected to become clear.

Specifically, it will be seen whether they will support the suspension of the imposed penalty for the 82-year-old or maintain the same stance and support the decision of the lower court.
