Eighteen Fire Department Officers take former Chief of Police to court

Eighteen Fire Department senior officers have appealed the new rejection by the former Chief of Police of their request for compensation for the working time that is related to the, for years, non-institutionalised policy of the “on-call” system to Court again.

The officers of the Fire Department are obligated to be on constant alert, “on-call”, for immediate and rapid assumption of duties in major emergencies, even after the end of their shifts.

In particular, the 18 affected officers challenge and oppose the re-decision of the Chief of Police, claiming the violation of Directive 2003/88, as far as the upper limit of work is concerned, in the light of, inter alia, the issuance of three decisions of the European Union’s Court of Justice (ECJ) on the same issue, which even concerns the Fire Department, with the “on-call system” and the related obligation of vigilance and rapid response to have been judged by the ECJ to constitute, assimilate and fall within the meaning of ” working hours” and not in the “rest period “, concepts which according to the case law of the ECJ, are “mutually exclusive”, data which were completely ignored by the former Chief of Police.

It is noted that the applicants request that the special standby allowance be paid to them from 2006 until 29/7/2015 time during which they worked under this system.
